We are committed to delivering high-quality portable fiberglass units with integrity and transparency. By purchasing our products, you agree to the following terms and conditions, which are designed to ensure a smooth and professional experience.

1. Definitions

In these terms and conditions:

  • "Company", "We", "Us" refers to Obasu Portable Solutions.
  • "Customer", "You" refers to the individual or entity purchasing products from the Company.
  • "Products" refers to portable fiberglass toilets, bathrooms, shower units, laundry units, and any related custom structures supplied by the Company.

2. Product Classification & Usage

Our units are classified as portable temporary structures made of fiberglass (FRP). They are not permanent residential dwellings. By purchasing, the Customer acknowledges that:

  • It is the Customer's sole responsibility to obtain any necessary municipal or council permits for the placement and use of the units.
  • The units are designed for portable use and must be placed on a flat, stable, and level surface to ensure structural integrity and proper function.

3. Orders & Payment

All orders are subject to acceptance by the Company. A quotation provided by the Company is valid for 14 days unless stated otherwise.

  • Full payment is required prior to delivery or collection, in accordance with the invoice terms.
  • Custom orders may require a non-refundable deposit upon confirmation.
  • Ownership of the Products passes to the Customer only upon full payment of the purchase price.

4. Delivery & Site Access

We strive to deliver your units safely and on time. To ensure a successful delivery:

  • Site Access: The Customer must ensure clear, safe, and unobstructed access for the delivery vehicle (typically a flatbed truck or crane truck).
  • Unloading: Delivery is strictly to the curb or the nearest accessible point at the designated address. Final placement, positioning, and connection to services (water/sewage/electricity) are the Customer's responsibility.
  • Inaccessible Sites: If the delivery site is deemed unsafe or inaccessible by our driver, the goods will be unloaded at the nearest safe location. Any additional costs incurred for redelivery or specialized equipment will be borne by the Customer.

5. Inspection & Acceptance

The Customer is required to inspect the Products immediately upon delivery. Any visible damage, defects, or discrepancies must be reported to the driver and noted on the delivery receipt at the time of receipt. Failure to do so constitutes acceptance of the Products in their delivered condition.

6. Returns & Cancellations

We stand by the quality of our products.

  • Standard Units: Returns of unused standard units may be accepted within 7 days at the Company's discretion, subject to a restocking fee and return transport costs.
  • Custom Units: Orders for customized or modified units are final and cannot be cancelled or returned once production has commenced.

7. Intellectual Property Rights

All intellectual property rights in the Products, including designs, specifications, and branding (such as the "Obasu" name and logo), remain the exclusive property of the Company. The Customer may not copy, reverse engineer, or reproduce any part of the Products without prior written consent.

8. Force Majeure

The Company shall not be liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, war, strikes, fire, flood, raw material shortages, or government restrictions.

9. Limitation of Liability

To the maximum extent permitted by the laws of the Kingdom of Saudi Arabia:

  • The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Products.
  • The Company’s total liability for any claim shall not exceed the purchase price of the Product giving rise to the claim.
  • We are not responsible for damage caused by improper installation, unlevel ground, extreme weather events, or failure to follow maintenance guidelines.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Jeddah.
